Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Reel Estate LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of the https://tryreelestate.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Services”).

By using the Services, you agree to be bound by these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Services and must discontinue use immediately.

1. OUR SERVICES

We provide a software-based tool allowing users to create short-form real estate videos from uploaded listing photos. Users are responsible for ensuring their use of the Services complies with all applicable laws, including U.S. and Texas law, California law where applicable, and all laws governing artificial intelligence-generated or modified media.

AI-Generated Content Disclosure:

The Services utilize artificial intelligence and machine learning technologies to generate or modify video content. As such, outputs may constitute “synthetic” or “AI-generated” media under applicable law.

Users are solely responsible for ensuring that any AI-generated or AI-assisted content created using the Services is properly disclosed, labeled, or otherwise used in compliance with applicable laws, including but not limited to the NAR Code of Ethics (Articles 2 and 12), applicable state synthetic media disclosure laws, and local MLS guidelines.

2. INTELLECTUAL PROPERTY RIGHTS

We own or hold licenses to all intellectual property rights related to the Services, including software, content, graphics, and trademarks. These materials are protected by U.S. and international intellectual property laws.

You retain ownership of any videos or content you upload to the site or create using our Services. By using our Services, you grant us a limited license to use your content.

3. USER REPRESENTATIONS

By using the Services, you represent that all registration information is accurate and that you will maintain the accuracy of such information. You confirm that you are at least 18 years old and will not use the Services for unlawful purposes.

4. USER REGISTRATION

You may need to register to access certain features of the Services. You are responsible for maintaining the confidentiality of your login information.

5. PURCHASES AND PAYMENT

We accept payment through the third party payment processor Stripe. You agree to provide current and complete payment information. Recurring payments will continue until you cancel. Sales tax may apply.

6. FREE TRIAL

Free trials are available for first-time users only. You will be charged at the end of the trial unless you cancel or change your subscription.

7. CANCELLATION

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your billing cycle. Contact hello@tryreelestate.com with any questions.

8. PROHIBITED ACTIVITIES

You agree not to misuse the Services. Prohibited activities include:

  • Creating or distributing deceptive, misleading, or unlawful synthetic media;
  • Using AI-generated content in a manner that violates disclosure or labeling requirements under applicable law;
  • Representing AI-generated content as authentic, unaltered, or human-created where such representation would be misleading or unlawful;
  • Using the Services in connection with fraud, impersonation, or misrepresentation;
  • Uploading viruses or other content to the site for a purpose other than creation of short form videos;
  • Uploading inappropriate or obscene content of any kind to the site;
  • Taking action that would infringe on the rights of others

9. USER UPLOADED CONTRIBUTION LICENSE

By uploading content to the site (“Contributions”), including photos, other images or audio, you grant us a limited, revocable, royalty-free license to store, render, and display the content for the purpose of providing and improving the Services.

We will not sell or distribute your uploaded content without your explicit written consent. You retain ownership and may request content removal subject to our data retention policies.

10. USER GENERATED CONTRIBUTIONS

You are solely responsible for content you generate using the Services (Generated Contributions). You grant us a revocable, royalty-free license to store, render, display or distribute your Generated Contributions for whatever purpose.

You further represent and warrant that:

  • Any use of AI-generated or AI-assisted content on your part complies with all applicable laws and regulations;
  • You will provide any required disclosures, notices, or labels indicating that content is AI-generated or modified where required by law;
  • Your Contributions do not unlawfully mislead consumers, viewers, or third parties regarding the nature or origin of the content.

You indemnify us against any claims arising from your Contributions, including claims related to failure to disclose AI-generated content.

10A. ARTIFICIAL INTELLIGENCE USE AND DISCLOSURE

The Services include features powered by artificial intelligence (“AI Systems”) that generate, modify, or enhance user content.

By using the Services, you acknowledge and agree that:

  1. Content generated by the Services may be partially or fully AI-generated and may not reflect real-world conditions, appearances, or events.
  2. You are solely responsible for determining whether any output generated using the Services requires disclosure under applicable law, including but not limited to:
    • NAR Code of Ethics Articles 2 and 12 (truthful advertising and disclosure of digitally altered content)
    • Applicable state synthetic media disclosure laws (including California AB 723)
    • Texas AI governance and disclosure requirements (including the TRAIGA act)
    • Federal Trade Commission (FTC) guidelines regarding deceptive practices
  3. The Company does not guarantee that outputs automatically comply with all legal requirements for labeling, disclosure, or permitted use.
  4. You may not use the Services to:
    • Create deceptive or misleading representations of properties;
    • Misrepresent materially important facts in real estate listings;
    • Generate content intended to deceive consumers regarding authenticity.

10B. AI CONTENT LABELING AND TRANSPARENCY

To the extent required under applicable law, we may include, embed, or enable metadata, watermarks, or other indicators identifying content as AI-generated or AI-assisted in the process of generating video content. You agree not to remove, obscure, or alter any such indicators where legally required. Where the Services we provide include labeling tools or disclosures, you agree to use them in good faith to comply with applicable laws.

If you distribute or publish content generated through the Services, you are responsible for ensuring appropriate clear and conspicuous disclosures where required.

10C. TEXAS AI GOVERNANCE AND RESPONSIBLE USE

In accordance with applicable Texas law governing artificial intelligence systems:

  1. You acknowledge that you, as the user and deployer of AI-generated content, are responsible for any and all use of such content. You further acknowledge that you are responsible for ensuring such use does not result in unlawful discrimination, deception, or consumer harm.
  2. You agree to exercise reasonable human review and judgment over AI-generated outputs prior to publication or use.
  3. You may not use the Services to:
    • Engage in unlawful discriminatory practices;
    • Produce content that materially misrepresents real estate listings;
    • Violate consumer protection laws.

Audit and Cooperation

You agree to reasonably cooperate with the Company in addressing any legal or regulatory inquiries related to your use of AI-generated content where required by law.

11. SOCIAL MEDIA

You may link your account with third-party social media platforms. You are responsible for maintaining compliance with their terms and authorize us to access shared data per your permissions.

12. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to third-party websites. We are not responsible for any content, policies, or practices of these third parties.

13. SERVICES MANAGEMENT

We reserve the right to manage the Services to ensure compliance with these Terms, including monitoring usage and removing content or users that violates these Terms of Service or applicable law.

We reserve the right to implement automated or manual safeguards, including labeling mechanisms, to monitor for violation of these Terms and to support legal compliance.

14. PRIVACY POLICY

We care about your privacy and data security. Please review our Privacy Policy at https://tryreelestate.com/privacy-policy. By using the Services, you consent to the terms of our Privacy Policy and the collection, use, and sharing of your information as described therein.

Our data handling practices comply with applicable U.S. privacy laws, including the Texas Data Privacy and Security Act (TDPSA). We collect, process, and store user data for the purposes of:

  1. Providing and improving the Services,
  2. Ensuring safety and compliance with applicable laws,
  3. Detecting misuse or prohibited activities

You have the right to access, correct, or delete your personal data and to opt out of the sale or targeted use of your personal information, subject to legal exceptions. Requests may be submitted to privacy@tryreelestate.com.

We implement appropriate technical and organizational measures to safeguard your data, including secure encryption of uploads and access controls.

15. COPYRIGHT INFRINGEMENTS

We respect intellectual property rights. If you believe any content on our Services infringes your copyright, please contact us with a proper notice.

15A. DMCA POLICY

If you believe any content on the Services infringes your copyright, you may submit a DMCA-compliant notification to our designated agent: dmca@tryreelestate.com.

Your notice must include:

  • A physical or electronic signature of the copyright owner or authorized agent;
  • Identification of the copyrighted work;
  • Identification of the infringing material and its location;
  • Your contact information;
  • A statement of good-faith belief that the use is unauthorized;
  • A statement under penalty of perjury of the accuracy of your claim.

Misrepresentations may subject you to liability under 17 U.S.C. § 512(f).

16. TERM AND TERMINATION

These Terms remain in effect while you use the Services. We may suspend or terminate your access for violations or illegal conduct without notice.

17. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to update or discontinue any part of the Services at any time. We are not liable for any unavailability or data loss resulting from such actions.

18. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in Frisco, Texas.

19. DISPUTE RESOLUTION

The Federal Arbitration Act and Texas law govern this provision. You and Reel Estate LLC agree to first attempt informal resolution of any dispute for at least 30 days before initiating arbitration.

Binding arbitration will be conducted under the AAA's rules in Frisco, Texas. You waive the right to trial by jury or participation in class actions.

If arbitration is found unenforceable, disputes shall be brought in state or federal courts in Frisco, Texas. You consent to jurisdiction and waive all defenses of lack thereof.

20. CORRECTIONS

We reserve the right to correct errors or inaccuracies in the Services without prior notice.

21. AI-GENERATED CONTENT DISCLAIMER

The Services include AI-generated outputs that may contain inaccuracies, omissions, or synthetic elements. We make no representations or warranties regarding:

  • The factual accuracy of AI-generated content;
  • Compliance of such content with disclosure or labeling laws;
  • Suitability of such content for real estate marketing or regulatory purposes.

22. LIMITATIONS OF LIABILITY

We are not liable for indirect or consequential damages. Our liability is limited to the amount you paid us in the 6 months preceding any claim.

23. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims arising from your use of the Services or violation of these Terms, including but not limited to violations of California applicable state synthetic media disclosure laws, Texas TRAIGA, NAR Code of Ethics, or any other applicable AI-related law or regulation.

24. USER DATA

You are responsible for your data and uploads. We are not liable for data loss or corruption.

25. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using the Services, you consent to receive communications electronically and agree to electronic transactions and signatures.

26. MISCELLANEOUS

These Terms are the entire agreement between you and us. If any part is found unenforceable, the rest remains in effect. No joint venture or agency relationship is created by these Terms. Nothing in these Terms shall be interpreted to limit any rights or obligations under applicable artificial intelligence, consumer protection, or synthetic media laws.

STAGING
